I think the Court got it mostly right. The aspects that might go under the radar are that checks and balances still work and the President can’t simply rule by fiat (executive order).
The proclivity to govern by EO is due to a number of factors: partisan gridlock, undoing and outdoing predecessors, a CEO mindset, and wanting to deliver results regardless of process. However, our system is one where the process matters much.
Birthright citizenship is a perfect example. We have this amendment partly to correct the wrongs of slavery, and obviously the framers of the amendment didn’t contemplate the issue of birth tourism, where hundreds of expectant mothers could arrive at once (do we have proof this is happening?). Yet we still have a process to fix the constitution to recognize domiciled mothers, if necessary. The problem is both parties govern by fear mongering sound bites than making clear and convincing arguments.
I believe the constitution should be interpreted simply and as written. The framers recognized it was imperfect.
Currently there are lots of issues where we need constitutional amendments: birthright citizenship, limiting partisan gridlock (congressional term limits and enforcing budgetary discipline such as making senators and representatives ineligible to run in the next election as a consequence of a lapse of appropriations), enforcing age limits on federal elected officials, and more clearly defining federal and state responsibilities. We have a process for that too. It’s a shame we’ve never used it when we should have.
Thanks for having Rod on your show.He is right on about Pritzker and Johnson. They are the worst politicians in history.I live in this state and literally can’t stand those two.I could go on but I can’t say how I really feel here.Great show Leland.Have a Happy 4th!Cant wait to celebrate with family and friends! Cheers!
Attack on blue cities blue politicians and crime. Crime seems to be independent of politics of government. See NYC for example murder rate started decreasing during Dinkins admin, a Dem. continued to decrease during Giuliani a Rep, continued to decrease during Bloomberg and has continued to decrease during subsequent mayors even decreasing during first half year Mamdami-where murder rate has continued to decrease/
Love when you have The 2 Way Trio on your show, Leland ! Looking forward to the show as I always do. Great War Notes, as usual ♥️
The court did well today. Common sense might still save us.
